11. Extended Technical Developer Liability Disclaimer

11.1 Nature of Service Provided

The technical developer Fabio Iadicicco, operating through unitesla.eu (hereinafter "the Developer"), has exclusively realized and provided technical services for the development, design, implementation, and extraordinary maintenance of the web platform of this website, acting solely as a provider of IT and technological services.

The platform is currently in operational management by the journalistic publication Stampa Campania, it being understood that intellectual and proprietary ownership remains with Developer Fabio Iadicicco, who grants its use under the terms and conditions provided in this disclaimer.

11.2 Free Conditional Grant of Use - No Remuneration

The Platform has been made available to the journalistic publication free of charge, without consideration, through a conditional grant of use, and not through definitive transfer of ownership or rights.

The Developer expressly and solemnly declares that:

  • Has not received, does not receive, and will not receive any compensation, economic consideration, remuneration, equity share, profit participation, direct or indirect benefit, or any other form of counter-performance for the creation, management, maintenance, or use of the platform;
  • Does not hold any equity participation, share, economic interest, or management role in the journalistic publication or its controlled/affiliated companies;
  • Acts exclusively on a voluntary and free basis, without any economic commitment, permanent contractual relationship, or employment relationship with the publication.

11.3 Total Exclusion of Liability for Content and Data

The Developer assumes no responsibility, direct, indirect, subsidiary, joint, or in any other capacity, in relation to:

11.3.1 Editorial and Journalistic Responsibility
  • Published content, articles, news, opinions, comments, and any other form of editorial content;
  • Editorial line, journalistic choices, political or ideological orientation of the publication;
  • Truthfulness, accuracy, completeness, updating, or reliability of published information;
  • Violations of the Journalists' Code of Ethics or press legislation;
  • Violations of fair coverage regulations or political communication standards.
11.3.2 GDPR and Privacy Responsibility

The Developer is not a Data Controller pursuant to Regulation (EU) 2016/679 (GDPR) and applicable privacy laws. The Data Controller for personal data collected through the platform is exclusively the journalistic publication Stampa Campania, represented by the Editor-in-Chief and/or Publisher.

The Developer assumes no responsibility for:

  • Processing of personal data of users, readers, authors, or third parties;
  • GDPR violations, including violations of principles of lawfulness, fairness, transparency, data minimization, accuracy, storage limitation, integrity, and confidentiality;
  • Data breaches, loss, theft, unauthorized disclosure, or unlawful processing of personal data;
  • Failure to comply with GDPR obligations, including information, consent, portability, erasure (right to be forgotten), opposition to processing;
  • Failure to appoint a DPO (Data Protection Officer) where required;
  • International data transfers, cookies, and tracking technologies;
  • Administrative sanctions imposed by Data Protection Authorities or other competent authorities.
11.3.3 Legal and Regulatory Responsibility
  • Defamation: defamatory, slanderous, or reputation-damaging content;
  • Copyright: copyright violations, unauthorized use of protected works, plagiarism, counterfeiting;
  • Image Rights: unauthorized use of photographs, images, or videos of persons;
  • Right to be Forgotten: failure to comply with removal or de-indexing requests;
  • Hate Speech: hate content, incitement to violence, racism, discrimination;
  • Fake News: publication of false, manipulated, or misleading news;
  • Protection of Minors: violations of regulations protecting minors;
  • Professional Secrecy: violations of investigative, professional, official, or state secrets;
  • Antitrust: hidden advertising, unfair commercial practices, consumer code violations;
  • Tax Regulations: tax violations, evasion, failure to invoice advertising or editorial services;
  • Labor Law: violations related to employment relationships with journalists, collaborators, or employees.
11.3.4 Administrative and Management Responsibility
  • Administrative, fiscal, accounting, and organizational management of the publication;
  • Relations with professional orders, regulatory authorities, privacy authorities, communication authorities;
  • Tax obligations, VAT, direct taxes, social security contributions;
  • Advertising contracts, sponsorships, commercial agreements;
  • Relationships with authors, collaborators, suppliers, advertisers.
11.3.5 Technical Responsibility for Uploaded Content
  • Content uploaded, modified, or published by editorial staff through CMS or administrative interfaces;
  • Configurations, settings, or customizations made by the publisher or editorial staff;
  • Data, databases, images, videos, multimedia files uploaded by site administrators;
  • Improper, negligent, or intentional use of the platform by administrators, editors, or authorized users;
  • Credential violations, password theft, unauthorized access (the Developer is not responsible for password custody by administrator users).

11.4 Absence of Editorial and Management Control

The Developer expressly declares not to exercise any control, direct or indirect, over:

  • Selection, writing, revision, editing, publication, or removal of editorial content;
  • Editorial, journalistic, commercial, or strategic decisions of the publication;
  • Management of editorial staff, collaborators, authors, or personnel;
  • Relationships with advertisers, sponsors, or commercial partners;
  • Administration, accounting, finance, or governance of the publication;
  • Content moderation, censorship, or publication policies;
  • Access to content management systems (CMS) after platform delivery;
  • Configurations, plugins, extensions, or customizations after delivery.

11.5 Exclusive Editorial Responsibility of Publisher and Editor

Pursuant to applicable press laws and subsequent amendments, all civil, criminal, administrative, editorial, journalistic, fiscal, and content-related responsibility is to be understood as exclusively and solely belonging to:

  • The Editor-in-Chief of the journalistic publication, Arnaldo Gadola, enrolled in the Order of Journalists since January 30, 1993;
  • The Publisher of the journalistic publication Stampa Campania;
  • The authors of individual articles and published content;
  • The editorial staff and editorial management body;
  • The Data Controller of personal data, as identified in the Privacy Policy.

11.6 Limitation of Liability - Exclusion of All Forms of Damage

The Developer cannot be held liable, even subsidiarily, jointly, concurrently, or in any other civil or criminal capacity, for:

  • Pecuniary damages: direct, indirect, consequential damages, loss of profits, loss of business opportunities, data loss;
  • Non-pecuniary damages: reputation damage, image damage, moral damage, existential damage, biological damage;
  • Administrative sanctions: fines, penalties imposed by supervisory authorities (Privacy Authority, Communications Authority, Antitrust, Tax Authority);
  • Criminal sanctions: criminal convictions, criminal proceedings against directors, publishers, or authors for press crimes or other offenses;
  • Compensation claims: civil actions, damage compensation requests, seizures, injunctions, payment orders;
  • Legal expenses: defense costs, attorney fees, technical consultants, experts, procedural costs;
  • Contractual violations: contractual breaches toward third parties, advertisers, suppliers, collaborators;
  • Service interruptions: downtime, malfunctions, cyber attacks, hacking, data breaches (except for willful misconduct or gross negligence proven in court);
  • Third-party content: content published by users, commentators, guest authors, external sources;
  • External links: content of websites linked or referenced in articles;
  • Embargo violations: publication of news under journalistic embargo or confidentiality constraints;
  • Improper use: use of the platform for illegal, fraudulent, or unauthorized purposes by administrators or third parties.

11.7 Hold Harmless, Indemnification, and Defense Clause

The journalistic publication Stampa Campania, represented by Editor-in-Chief Arnaldo Gadola and the Publisher, irrevocably and unconditionally undertakes to:

  • Hold harmless and indemnify the Developer from any claim, demand, legal action (civil, criminal, administrative, tax), dispute, complaint, report, lawsuit, judicial or arbitration proceeding;
  • Fully assume all costs, legal expenses, attorney and consultant fees, procedural costs, sanctions, fines, damage compensation, and any other economic burden arising from:
    • Content published on the platform;
    • Violations of third-party rights (defamation, privacy, copyright, image);
    • GDPR or privacy law violations;
    • Press law violations, journalists' code of ethics violations;
    • Any editorial, journalistic, content-related, or management dispute;
    • Sanctions imposed by supervisory authorities (Privacy Authority, Communications Authority, Antitrust, etc.);
    • Criminal proceedings for press crimes or other offenses committed through publication;
  • Guarantee judicial defense of the Developer, entirely at the publication's expense, in case of involvement in legal proceedings arising from editorial activity;
  • Fully reimburse the Developer for any amount that the latter might eventually be ordered to pay in relation to the above matters, within 30 days of written request;
  • Expressly waive any action for recourse, regression, or repetition against the Developer for matters covered by this disclaimer.

11.8 Separation of Responsibilities - No Partnership

The Developer and the journalistic publication expressly declare that:

  • No partnership, association, joint venture, or co-participation relationship exists;
  • No employment, coordinated collaboration, or agency relationship exists;
  • The Developer is not a co-publisher, co-director, or co-responsible for the publication;
  • Responsibilities are completely separate and independent;
  • The Developer acts exclusively as an external technical provider, without any management, editorial, or decision-making role.

The grant of use of the Platform does not constitute in any way partnership, association, co-publishing, or editorial co-responsibility, nor does it grant the publication any permanent or irrevocable right over the technological infrastructure.

11.9 Applicable Law and Jurisdiction

This disclaimer is governed by Italian law. For any dispute relating to the interpretation, validity, or execution of this disclaimer, the Court of Naples shall have exclusive jurisdiction. In case of conflict between this disclaimer and other clauses of the Terms and Conditions, this disclaimer shall prevail regarding the Developer's responsibilities.

11.10 Validity and Severability of Clauses

Should one or more provisions of this disclaimer be declared null, invalid, or ineffective by a competent judicial authority, such nullity, invalidity, or ineffectiveness shall not extend to the remaining provisions, which shall remain fully valid and effective. The parties undertake to replace the invalid clause with a valid clause of similar content.

11.11 Express Acceptance of Disclaimer

Use of this website and access to its content implies full, unconditional, and irrevocable acceptance of this disclaimer by users, the Editor-in-Chief, the Publisher, and all parties involved in managing the journalistic publication. The journalistic publication expressly acknowledges the validity and binding nature of this disclaimer in relations with the Developer.

11-bis. Platform Ownership and Conditional Grant of Use

11-bis.1 Intellectual and Proprietary Ownership

The technological platform of this website, including source code, software architecture, application structure, databases, interfaces, operational logic, customizations, technical documentation, and any other tangible and intangible element composing it (hereinafter the "Platform"), is and remains the exclusive intellectual and proprietary property of Developer Fabio Iadicicco.

11-bis.2 Operational Management Regime

The journalistic publication Stampa Campania uses the Platform under mere operational management, without acquiring any ownership, co-ownership, title, definitive transfer, or real right over it.

11-bis.3 Non-Exclusive and Conditional Grant of Use

The Developer grants Stampa Campania a non-exclusive, non-transferable, non-sublicensable, and strictly conditional right of use of the Platform, limited exclusively to the purposes of publishing and managing editorial content of the publication.

Such grant of use:

  • does not constitute transfer of rights;
  • does not entail transfer of intellectual property;
  • does not generate acquired rights for the publication;
  • is revocable as provided in this article.

11-bis.4 Right of Revocation

The Developer reserves the unquestionable right to revoke, suspend, or limit the use of the Platform at any time, without obligation of prior notice, without need for justification, and without this entailing any right to indemnities, compensation, or damages in favor of Stampa Campania.

11-bis.5 Effects of Revocation

In case of revocation or termination of the authorization to use:

  • Stampa Campania must immediately cease use of the Platform;
  • no claim may be advanced against the Developer;
  • all hold harmless and limitation of liability clauses provided in Article 11 shall remain valid;
  • the Developer shall not be required to provide technical support, maintenance, or assistance of any kind;
  • any data or content present on the Platform may be made available for export at the Developer's discretion, without any obligation in this regard.

11-bis.6 Absence of Warranties

The Platform is granted "as is" and "as available", without warranties of any kind, express or implied, including but not limited to:

  • warranties of service continuity;
  • warranties of availability or uptime;
  • warranties of suitability for specific editorial or commercial purposes;
  • warranties of absence of errors, bugs, or malfunctions;
  • warranties of compatibility with third-party software, hardware, or services;
  • warranties of absolute security from cyber attacks or data breaches.

11-bis.7 Moral Rights of the Author

The Developer reserves all moral rights of the author over the Platform pursuant to applicable copyright laws, including:

  • the right to paternity of the work;
  • the right to integrity of the work;
  • the right to oppose modifications, deformations, or mutilations that may harm the honor or reputation of the Developer;
  • the right to claim authorship of the work and to oppose any deformation, mutilation, or other modification of the work itself.

11-bis.8 Unauthorized Modifications and Customizations

It is expressly prohibited for Stampa Campania and anyone acting on its behalf to:

  • modify the Platform's source code;
  • decompile, disassemble, or perform reverse engineering;
  • remove or alter copyright notices, licenses, or other proprietary notices;
  • create derivative works from the Platform;
  • grant sublicenses, sell, rent, or transfer usage rights to third parties;
  • use the Platform for purposes other than the publication's editorial activities;
  • use the Platform in violation of laws, regulations, or third-party rights.

11-bis.9 Legitimate Use and Limitations

Stampa Campania undertakes to use the Platform exclusively for the editorial purposes of the journalistic publication and in compliance with all applicable laws and regulations.

It is prohibited to use the Platform for:

  • illegal, fraudulent, or rights-infringing activities;
  • distribution of malware, viruses, or harmful code;
  • cyber attacks, hacking, or attempts to compromise security;
  • violations of intellectual property, privacy, or other rights;
  • commercial purposes other than registered editorial activity;
  • resale, rental, or granting of use to third parties.

11-bis.10 Waiver of Acquired Rights

Stampa Campania expressly and irrevocably acknowledges that:

  • prolonged use of the Platform does not generate any acquired rights;
  • it cannot invoke any legitimate expectation of service continuation;
  • it cannot oppose revocation of the authorization to use;
  • it cannot request compensation, indemnities, or damages for revocation;
  • it cannot claim co-ownership, condominium, or possession rights over the Platform;
  • it expressly waives any claim or legal action related to termination of the authorization to use.

11-bis.11 Prevalence and Interpretation

The provisions of this Article 11-bis prevail over any other clause of the Terms and Conditions in case of conflict. In case of interpretative doubt, clauses shall be interpreted in the sense most favorable to the protection of the Developer's intellectual and proprietary rights.
